We appreciate your interest in the game “D.A.M.N!”, website https://www.dam-n.com, online communities, owned and operated by Sole Proprietor Komisarenko Maksym (together with our services and products, our “Services”).
Sole Proprietor Komisarenko Maksym (“Developer”, “we” or “us” or “our”) respects your privacy and is committed to protecting your Personal Data (as defined below). This privacy policy describes how your Personal Data is collected, handled and stored as well as your data protection rights.
“Personal Data” or “Personal information” means any information about an individual from which that person can be identified directly or indirectly. It does not include data where identity is removed (anonymous data). The notion of Personal Data covers all information defined as personal data under Art. 4 (1) GDPR.
This privacy policy is designed to apply to our Website visitors and users of our Services on a global basis.
1Controller of your Personal Data
Sole Proprietor Komisarenko Maksym (15000, Ukraine, Chernihiv Region, Ripky District, urban-type settlement of Ripky, 18 Popudrenka Street) is the data controller within the meaning of Art. 4(7) GDPR with respect to all personal information collected through the Website and Services. Accordingly, Developer is responsible for, and controls, the processing of your personal information collected through the Services.
The information provided to or collected by us from players and website visitors is strictly limited to operating, providing, maintaining, securing, and improving the Game, Website, and related Services.
Developer acknowledges that you have the right to access your Personal Data. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct their query to Developer (the data controller). Upon receiving a request to access, modify, or remove your Personal Data, we will respond within a reasonable timeframe and in accordance with applicable data protection laws.
If you wish to contact us, you can find our contact details at the end of this privacy policy.
2Types of Data and Data Collection
Developer respects your privacy and processes only the minimum amount of Personal Data necessary to provide our Services.
Data is collected through the following methods and systems:
2.1 Platform Authentication Data (Steam, Android and iOS)
Depending on the platform you use to play the game, we process authentication data differently to establish your game session and enable multiplayer features:
- Steam: When you launch the game through Steam, we receive your Steam ID (SteamID64) to identify you, your public Steam Persona Name and Avatar (shown in menus and lobbies), and a short-lived Steam Authentication Ticket (passed to Epic Online Services to sign you in, which we do not store). Additionally, the game uses Steam Rich Presence to show your status to Steam friends, governed by your own Steam privacy settings.
- Mobile Platforms (Android and iOS): When playing on mobile devices, the game does not require an account registration, nor does it collect your name, email, or avatar. Instead, the Epic Online Services SDK generates a unique, anonymous, device-linked identifier to silently authenticate you and connect you to the online services
2.2 In-Game Data and Telemetry
The Demo version of the Game does not collect or transmit gameplay telemetry or analytics to our servers. All gameplay processing is handled locally, with external services used strictly for authentication and networking. This includes:
- Online Multiplayer Connection: to enable multiplayer functionality, your Epic Online Services (EOS) Player ID is processed to establish and maintain game sessions. This ID is not externally linked to your public Steam profile (if playing on Steam) or any other external identities.
- In-Game Text Chat: The game includes a text chat feature that allows players to communicate during a match. Chat messages are transmitted in real-time through Epic Online Services (EOS) relays. We do not collect, monitor, log, or store these messages on our servers.
- Local Match Data and Progress: Match history, game statistics and in-game points are stored exclusively on your local device. We do not store or retain this data on remote servers or external databases. You may clear or delete this data at any time directly through your device's file system, system application settings, or by uninstalling the game.
- Crash Reports: We do not automatically upload crash logs. Local Player.log files are stored strictly on your device. You may choose to share them with us manually via bug report channels.
- Language Preference: Your explicitly selected language preference, saved to provide localized in-game text and content.
2.3 Website and Analytics (dam-n.com)
Our public web presence is designed with a minimal data footprint:
- We use Cloudflare Web Analytics, which provides cookie-free, privacy-respecting insights into website traffic.
- If and when cookies are used on our website, they are strictly limited to essential cookies (e.g., session management, cookie consent settings).
3Use of Personal Data and Legal Bases
The reasons the Developer uses your personal data depend on how you interact with Services. Because we practice strict data minimization, we only process your information for the following purposes and on the following legal grounds:
To Perform Our Contractual Services (Providing access to the Game): When you launch and play our game, Developer processes your data to perform the agreement to provide you with the multiplayer gaming experience. This is strictly limited to using your platform authentication data (such as Steam ID or mobile device-linked identifier) and EOS Player ID to authenticate your session, connect you to matchmaking servers, and enable basic game functionality. All match history, in-game points and gameplay statistics are saved exclusively on your local device.
For Our Legitimate Business Interests: We process limited technical information based on our legitimate interest to maintain network stability and troubleshoot technical issues. This includes reviewing local log files strictly when you voluntarily submit them to us via the bug report form.
Based on Your Consent: In specific cases, we may ask for your explicit consent to process certain data. We will request your consent before placing any non-essential cookies on our promotional website (dam-n.com). You are always free to deny or withdraw your consent at any time without negative consequences to your core gaming experience.
To Comply with Legal Obligations: We may process, retain, or share your data if we are legally required to do so. This includes responding to lawful requests from law enforcement agencies, cooperating with legal proceedings, or protecting the safety, rights, and property of our studio, our players, or the public.
4Data Security
We have implemented strict technical and administrative security measures designed to protect your data from unauthorized access, disclosure, or modification:
All data transmitted during game sessions is securely encrypted using industry-standard protocols. To ensure your EOS Connect ID login sessions remain safe, we utilize secure, short-lived authentication tokens, and access to online session features is strictly controlled so that only authenticated systems process your connectivity data. To prevent client-side manipulation and protect multiplayer integrity, our game relies on a server-authoritative architecture that securely handles critical game mechanics. Additionally, any game logs or save files generated locally on your device are designed to be completely free of Personally Identifiable Information (PII) or sensitive data. Finally, in the event of a data security incident, we will promptly notify the relevant supervisory authorities and affected individuals as required by applicable law.
We process Personal Data only to fulfill the purposes for which it was collected, including providing access to the Game, enabling platform authentication, and maintaining multiplayer services via Epic Online Services. In this Demo version, the Game does not send, collect, or retain any gameplay telemetry, match history, in-game points or player statistics on our servers. All match history, settings, in-game points and gameplay statistics are saved strictly on your local device and can be cleared or deleted by you at any time.
Your own practices are also important for the protection of your privacy. Since our game may utilize public profiles (such as your Steam account on PC) for authentication and profile display, please keep the following in mind:
- Be careful of what you share publicly. Do not share personal information (like your real name, address, or phone number) in the in-game text chat or on our community Discord server. We have no control over what other players might do with the information you voluntarily share in public lobbies.
5Data Protection Rights
Subject to applicable law, you hold several fundamental rights regarding your personal information:
- You have the right to correct or update certain types of Personal Data.
- You have the right to request deletion of your Personal Data. You can request data deletion by contacting us at support@dam-n.com. The only personal data associated with you outside of your device is your Epic Online Services (EOS) Player ID. This ID is retained only for as long as you use our Services. Upon a valid request, we will instruct Epic Games to permanently delete this identifier within 30 days of verification. We do not maintain our own separate database of players. We will only retain minimal data (such as the email correspondence regarding your request) to document your request and comply with legal obligations. Data stored exclusively on your device (such as match history, statistics, language preference, and in-game settings) does not have a set retention period on our end. You can delete this data instantly at any time by clearing the application's data in your device's system settings or by uninstalling the game.
- You have the right to restrict certain processing of your Personal Data and the right to object to some types of processing of your Personal Data.
- You have the right to withdraw your consent at any time.
- You have the right to lodge a complaint regarding collection, storage, or processing of your Personal Data with a data protection supervisory authority in the country where you live or work.
6US residents
If you are a US resident, you may have rights under your state’s privacy laws, such as the California Consumer Privacy Act (as amended by the CPRA). We collect the categories of data described in section 2 for the purposes in section 3. We do not sell or “share” your personal data for cross-context behavioural advertising, and we do not use it for targeted advertising. Subject to your state’s law, you may have the right to know what we collect, to request access or deletion, to correct inaccurate data, and to opt out of any sale or sharing — and we will not discriminate against you for exercising these rights. To make a request, email support@dam-n.com.
7Data Transfer
We are based in Ukraine and serve players globally (including in the European Economic Area, the United Kingdom, the United States, and other regions). Because our multiplayer infrastructure and third-party service providers - such as Epic Games, Inc. and Valve Corporation in the United States - operate internationally, your Personal Data may be transferred to, stored, or processed in countries outside your country of residence.
Whenever we transfer Personal Data outside the EEA or the UK, we rely on appropriate safeguards - such as adequacy decisions, the EU Standard Contractual Clauses, or the UK International Data Transfer Agreement - so that your data remains fully protected.
8Children’s Personal Information
A “Child” is a person under the age needed to consent to the processing of Personal Data in their country of residence (for example, 13 years old in the United States and between 13 and 16 years old in the European Union).
We do not knowingly collect Personal Data from a Child. If you are a Child, do not submit any Personal Data to us. If you become aware that a Child has provided us with Personal Data, please contact us at support@dam-n.com and we will delete it promptly.
